4.1.2. If the consumer notifies the Operator within the statutory 14-day period in accordance with these terms and conditions that he is withdrawing from the contract, the Purchase contract is cancelled from the beginning. To withdraw from the contract, the consumer can use the proof of purchase that he received with the purchased goods, or this general form for withdrawal from the contract and complaints. The form must contain at least the consumer’s name and surname, order number, product description and account number for refund.

4.1.3. The period for withdrawal from the Purchase contract is deemed to have been observed if the consumer, during the term of the Purchase contract, sends a notification to the Operator that he is withdrawing from the Purchase contract on the last day of the period. In the event of withdrawal from the Purchase contract, the Purchase contract is cancelled from the beginning..

4.1.4. The consumer has the right, within this period, after receipt, to unpack and test the goods in a manner similar to that which is usual when purchasing in a classic “brick and mortar” store, to the extent necessary to determine the nature, properties and functionality of the goods. In the event that the consumer withdraws from the Purchase contract within the statutory 14-day period, the consumer is liable for any reduction in the value of the goods resulting from such treatment of the goods that goes beyond the treatment necessary to determine the properties and functionality of the goods.

4.1.5. The consumer acknowledges that, in accordance with the provisions of Section 7(6) of the Act on Consumer Protection in the Sale of Goods based on a distance contract, he cannot withdraw from a Purchase contract, the subject of which is in particular:

– sale of goods that are subject to rapid deterioration or rapid deterioration of quality;

– sale of goods that, due to their nature, may be inseparably mixed with other goods after delivery;

The Operator will return the funds received to the consumer in another way, if the consumer has agreed to this and if this does not incur additional costs.

4.1.9. If the consumer withdraws from the Purchase contract, the Operator is not obliged to return the received funds to the consumer before the consumer hands over (delivers) the goods to him or proves that he has sent the goods to the Operator.

4.1.10. If, in accordance with applicable legislation, the consumer withdraws from the Purchase contract, he or she is entitled to use the “return shipment” label, take the packaged goods to the nearest branch of the Packeta and thus not pay postage. It is sufficient to request this return shipping label from the Operator by email or telephone. After receiving the package with the goods, the Packeta will then deliver it to the Operator. If the consumer is unable to return the goods through the Packeta, the Operator will refund the postage costs to him or her upon request in the amount corresponding to the cheapest method of sending the goods offered. The amount of the refunded amount is based on the price list of the Packeta. If the consumer returns goods from one order in multiple shipments, he or she is entitled to use one label, or is entitled to a refund of postage only once.

4.1.11. If the consumer sends the goods to the Operator despite not meeting the legal conditions for withdrawal from the contract, the goods will not be accepted or will be sent back at the consumer’s expense.

4.1.12. If a gift is provided to the Buyer together with the goods, a gift contract is concluded between the Operator and the Buyer with a condition on termination of the contract, and if the Buyer withdraws from the Purchase contract, the gift contract in relation to the gift loses its effect and the Buyer is obliged to return the goods with the provided gift to the Operator.

4.1.13. The Buyer may withdraw from the Purchase contract, the subject of which is the purchase of goods, even before the withdrawal from the Purchase contract period begins.

If the Buyer does not accept the substitute performance or withdraws from the Purchase contract within a reasonable period of time, the Operator is entitled to withdraw from the Purchase contract in such cases.

4.2.2. The Operator also has the right to withdraw from the Purchase contract if the supplier of the ordered goods has significantly changed the prices to the Operator, e.g. due to a sudden change in exchange rates or if significant changes in the prices of the transport of goods have occurred and the Buyer has not accepted the relevant change to the Purchase contract, i.e. an increase in the price of the goods or an increase in the costs of transport.

4.2.3. The Buyer acknowledges that the Operator is not obliged to conclude a Purchase contract with the Buyer, in particular if the Ordering Party is a consumer who has materially breached his obligations arising from the Purchase contract in any of his previous purchases. The Buyer further acknowledges that the Operator is entitled to withdraw from the Purchase contract concluded with a Buyer who has materially breached his obligation in any of his previous relationships relating to obligations with the Operator and has not fulfilled all of his obligations arising from previous contractual relationships.

4.2.4. If the Operator withdraws from the Purchase contract, he is obliged to immediately inform the Buyer at the email address provided by the Buyer when creating the order. He is also obliged to refund the full Purchase price of the goods to the Buyer, if it has already been paid.

4.2.5. If, due to the sale of stocks or unavailability of goods, the Operator is unable to deliver the goods to the Buyer within the period agreed in the Purchase contract or determined by these business and complaint terms and conditions or at the agreed Purchase price, the Operator is obliged to offer the Buyer a substitute performance or the option for the Buyer to withdraw from the Purchase contract (cancel the order). The Buyer may withdraw from the Purchase contract or cancel the order by delivering an e-mail. If the Buyer has already paid the Purchase price or part thereof, the Operator will return the already paid Purchase price or part thereof within 14 days from the date of delivery of the e-mail on withdrawal from the Purchase contract or cancellation of the order to the Buyer to the account specified by him, unless the Contracting parties agree otherwise. If the Buyer does not accept the replacement performance offered by the Operator within a reasonable period of time or does not withdraw from the Purchase contract, the Operator is entitled to withdraw from the Purchase contract and if the Buyer has already paid the Purchase price or part thereof, the Operator is obliged to return the already paid Purchase price or part thereof without undue delay, but no later than 14 days from the date of delivery of the withdrawal from the Purchase contract to the Buyer in the same way as the Buyer used for his payment, unless another method of return is agreed with the Buyer without additional fees being charged to the Buyer.
